CrPC 320 to BNSS 359 at a Glance

Section 320 CrPC (Compounding of offences) is now Section 359 BNSS, in force from 1 July 2024. What changed is set out below.

What Changed From CrPC 320 to BNSS 359?

Section 320 of the Code of Criminal Procedure, 1973 became Section 359 of the Bharatiya Nagarik Suraksha Sanhita, 2023 from 1 July 2024, with Section 320(1) CrPC through Section 320(9) CrPC in Section 359(1) BNSS through Section 359(9) BNSS. Changes of form replace Indian Penal Code citations in the two tables and in Section 359(3) BNSS with the corresponding provisions of the Bharatiya Nyaya Sanhita, 2023, update the revision reference in Section 359(6) BNSS from Section 401 CrPC to Section 442 BNSS, and spell out each Ditto in the third column. The first table omits the entry for adultery under Section 497 IPC, as the Bharatiya Nyaya Sanhita, 2023 has no offence of adultery, and combines the entries for Sections 428 and 429 IPC into one entry for Section 325 BNS. Section 359(4)(a) BNSS replaces the words under the age of eighteen years or is an idiot or a lunatic with a child or of unsound mind.

What CrPC 320 to BNSS 359 Means in Practice

From 1 July 2024, the provision governing the compounding of offences is found in Section 359 of the Bharatiya Nagarik Suraksha Sanhita, 2023 instead of Section 320 of the Code of Criminal Procedure, 1973. The distinction between offences compoundable without court permission under Section 359(1) BNSS and those requiring court permission under Section 359(2) BNSS is unchanged, as are the requirements for court leave in appeals, the bar in Section 359(7) BNSS where a previous conviction makes the accused liable to enhanced punishment or a punishment of a different kind, and the effect of an acquittal on composition.

FAQs: CrPC 320 to BNSS 359

Did Section 359 BNSS change the requirement of court permission for compounding offences compared to Section 320 CrPC?▼

No, the rule is unchanged. Both Section 320 of the Code of Criminal Procedure, 1973 and Section 359 of the Bharatiya Nagarik Suraksha Sanhita, 2023 divide compoundable offences into two tables. Offences in the table under Section 320(1) CrPC and Section 359(1) BNSS may be compounded by the person named in the third column without court permission, while offences in the table under Section 320(2) CrPC and Section 359(2) BNSS require the permission of the court where the prosecution is pending.

What changed in the tables of compoundable offences between Section 320 CrPC and Section 359 BNSS?▼

The tables in Section 359(1) and Section 359(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023 replace the Indian Penal Code section numbers in Section 320 of the Code of Criminal Procedure, 1973 with the corresponding provisions of the Bharatiya Nyaya Sanhita, 2023. In addition, the table in Section 359(1) BNSS omits the entry for adultery under Section 497 of the Indian Penal Code, as the Bharatiya Nyaya Sanhita, 2023 has no offence of adultery, combines the entries for Sections 428 and 429 IPC into one entry for Section 325 BNS, and spells out every Ditto entry in the third column.

How did Section 359(4)(a) BNSS update the wording of Section 320(4)(a) CrPC on compounding on behalf of an incapacitated person?▼

Under Section 320(4)(a) of the Code of Criminal Procedure, 1973, a person competent to contract could compound an offence with court permission when the competent person was under the age of eighteen years or was an idiot or a lunatic. Section 359(4)(a) of the Bharatiya Nagarik Suraksha Sanhita, 2023 replaces those words with a child or of unsound mind, while keeping the requirement to obtain the permission of the court unchanged.
