IEA 2: Repeal of enactments, No Corresponding BSA Section
The Bharatiya Sakshya Adhiniyam, 2023 has no section corresponding to Section 2 IEA.
What Happened to IEA 2?
Section 2 of the Indian Evidence Act, 1872 (repeal of enactments) had already been repealed by the Repealing Act, 1938, so there was nothing to carry into the BSA.
IEA 2 Has No Corresponding BSA Section
The Bharatiya Sakshya Adhiniyam, 2023 replaced the Indian Evidence Act, 1872 from 1 July 2024. The official comparison tables list no section of the Adhiniyam for Section 2 IEA (Repeal of enactments).
What IEA 2 Means in Practice
The BSA has no corresponding section for Section 2 IEA. Section 2 IEA covered the repeal of enactments and was repealed by the Repealing Act, 1938.
