Section 159 BNS in Simple Words

Section 159 BNS of the Bharatiya Nyaya Sanhita (BNS) deals with conduct that threatens discipline in the armed forces. It applies when a person knowingly tries to turn a soldier, sailor, or airman away from duty, or helps stir up mutiny. The law is aimed at protecting obedience, loyalty, and order within the military and other defence services. This section is serious because even an attempt to influence service personnel against lawful duty can create wider risk for national security and unit discipline.

It is not limited to physical acts. Words, messages, persuasion, or other conduct may all be covered if they are meant to weaken duty or encourage disobedience. In practice, this section is used where the accused targets serving personnel with the intention of causing defection, disloyalty, or mutinous behaviour.

Ingredients of Section 159 BNS

  • An officer, soldier, sailor or airman in the Army, Navy or Air Force of the Government of India
  • Abetting the committing of mutiny, or attempting to seduce that person from his allegiance or his duty

The offender is also liable to fine.

Non-Bailable โ“˜Cognizable โ“˜Non-Compoundable โ“˜๐Ÿ›๏ธ Court of Session โ“˜

Abetting mutiny, or attempting to seduce a soldier, sailor or airman from his duty, carries imprisonment for life, or up to ten years, and liability to fine.

Example of Section 159 BNS

A civilian travels to an army camp and urges a group of soldiers to seize the armoury and refuse the orders of their commanding officer. He does not take part in the mutiny himself, but he abetted it, and he is liable under Section 159 BNS.

When Section 159 BNS Does Not Apply

  • The person approached was not an officer, soldier, sailor or airman in the Army, Navy or Air Force of the Government of India
  • The accused neither abetted a mutiny nor tried to seduce the person from his allegiance or his duty
  • The mutiny has been committed in consequence of the abetment, which is punished under Section 160 BNS

Section 159 BNS in the IPC (Previous Law)

Section 159 BNS replaces Section 131 IPC from the old criminal code.

Section 131 IPC is now Section 159 BNS, with the same words and the same punishment. The one change is that Section 159 BNS has no Explanation. The IPC Explanation, which made the section cover a person subject to the Army Act, the Naval Discipline Act or the Air Force Act, is not carried into the BNS.
