Section 161 BNS in Simple Words

Section 161 of the Bharatiya Nyaya Sanhita (BNS) deals with abetment of an assault by a member of the armed forces on a superior officer while that officer is acting in the course of duty. In simple terms, this section does not punish the assault alone. It punishes the person who helps, encourages, or instigates the armed forces personnel to attack a superior officer when the superior is performing official work.

This provision applies only where the accused intentionally assists the act. The person may be a civilian or any other person who abets the offence. The law treats such conduct seriously because discipline in the armed forces depends on obedience to lawful authority.

If someone interferes with that discipline by encouraging violence against a superior officer in service, criminal liability can follow. In practice, the prosecution must show both the act of abetment and the official status of the target officer at the time of the incident.

Ingredients of Section 161 BNS

  • An assault by an officer, soldier, sailor or airman in the Army, Navy or Air Force of the Government of India
  • The person assaulted was a superior officer in the execution of his office
  • Abetment of that assault

Abetting an assault by a soldier, sailor or airman on a superior officer in the execution of his office carries imprisonment for up to three years and liability to fine.

Example of Section 161 BNS

A civilian tells a soldier that he should strike his commanding officer while the officer is inspecting the parade, and offers him money to do it. The soldier does not carry out the assault. The civilian is liable under Section 161 BNS for the abetment, and if the assault is committed Section 162 BNS applies.

When Section 161 BNS Does Not Apply

  • The assault was committed in consequence of the abetment, which is punished under Section 162 BNS
  • The superior officer was not in the execution of his office
  • The person who was to assault was not an officer, soldier, sailor or airman of the Government of India

Section 161 BNS in the IPC (Previous Law)

Section 161 BNS replaces Section 133 IPC from the old criminal code.

Section 133 IPC is now Section 161 BNS, with the same words and the same punishment.

FAQs on Section 161 BNS

Does Section 161 BNS apply only to soldiers?โ–ผ

No. It applies to officers, soldiers, sailors, and airmen in the Army, Navy or Air Force of the Government of India. The core requirement is that the person being encouraged to assault must belong to one of these categories, and the victim must be a superior officer in the execution of his office.

Can a civilian be punished under Section 161 BNS?โ–ผ

Yes. A civilian can be liable if he or she intentionally abets the assault. The law is concerned with the act of instigation or assistance, not only with the status of the abettor.

Under Section 161 BNS, what if the superior officer was not on duty?โ–ผ

Then this section may not apply. The offence is tied to the superior officer acting in execution of office, so the prosecution must prove that official link.

Is Section 161 BNS the same as directly assaulting the officer?โ–ผ

No. This section covers abetment, not the assault itself. The person who actually commits the assault may face separate charges, while the abettor is punished for helping or encouraging the act.
