Section 71 BNS in Simple Words

Section 71 of the Bharatiya Nyaya Sanhita (BNS) deals with repeat offenders in serious sexual offence cases. It applies where a person has previously been convicted of an offence punishable under Section 64, Section 65, Section 66, or Section 70 BNS and is subsequently convicted of an offence punishable under any of those sections. The law treats such conduct as a grave threat to public safety and women's security.

The practical effect is severe. Upon a subsequent conviction for any of the specified offences, the offender must be sentenced to imprisonment for life, meaning imprisonment for the remainder of the person's natural life, or death. Courts do not treat this as an ordinary repeat offence.

The section sends a strong message that repeated sexual violence attracts the harshest punishment under criminal law.

Ingredients of Section 71 BNS

  • Prior conviction for an offence punishable under the specified sexual offence provisions
  • Subsequent conviction for an offence punishable under any of the designated sections
  • Prescribed statutory sentence restricted to imprisonment for the remainder of natural life, or death
  • Updated cross-references under Section 71 BNS citing Section 64 BNS, Section 65 BNS, Section 66 BNS, and Section 70 BNS

No fine is provided under this section

Non-Bailable β“˜Cognizable β“˜Non-Compoundable β“˜πŸ›οΈ Court of Session β“˜

Section 71 BNS provides enhanced punishment for repeat sexual offenders, prescribing imprisonment for the remainder of natural life or death. The provision specifies no fine. Proceedings are cognizable, non-bailable, and triable exclusively by the Court of Session.

Example of Section 71 BNS

In a trial before the Sessions Court at Cuttack, the prosecution proved that the accused, Sunil, had previously suffered a final conviction under Section 64 BNS for rape five years earlier. Following his release, Sunil was prosecuted and found guilty of committing another offence punishable under Section 64 BNS against an adult woman. Because Sunil had a prior conviction under Section 64 BNS and was subsequently convicted of another qualifying sexual offence under the same statutory group, Section 71 BNS applied to the sentencing stage. Sunil was sentenced to imprisonment for the remainder of his natural life under Section 71 BNS, which permits only imprisonment for natural life or death.

When Section 71 BNS Does Not Apply

Section 71 BNS in the IPC (Previous Law)

Section 71 BNS replaces Section 376E IPC from the old criminal code.

Section 376E IPC corresponds to Section 71 BNS. The enhanced sentencing framework prescribing imprisonment for the remainder of natural life or death for repeat sexual offenders is preserved without change. The list of qualifying trigger offences is updated to reflect the consolidated structure of the Bharatiya Nyaya Sanhita: whereas Section 376E IPC referenced Section 376 IPC, Section 376A IPC, Section 376AB IPC, Section 376D IPC, Section 376DA IPC, and Section 376DB IPC, Section 71 BNS cites Section 64 BNS, Section 65 BNS, Section 66 BNS, and Section 70 BNS. The substantive sentencing standard remains identical.
