FAQs on Section 80 BNS
Under Section 80 BNS, what must the prosecution prove in a dowry death case?โผ

Under Section 80 BNS, is every death of a married woman treated as dowry death?โผ
No. The death must fit the legal conditions under this section. If there is no dowry-linked cruelty, or if the death occurred outside the seven-year period, this section does not apply, though other offences may still be attracted.

Under Section 80(1) BNS, once it is shown that the woman died of burns, bodily injury, or otherwise than under normal circumstances within seven years of marriage and was subjected to cruelty or harassment soon before her death in connection with a dowry demand, such husband or relative shall be deemed to have caused her death.
What does Section 80(2) of the Bharatiya Nyaya Sanhita cover?โผ

Bare Act Text
(1) Where the death of a woman is caused by any burns or bodily injury or occurs otherwise than under normal circumstances within seven years of her marriage and it is shown that soon before her death she was subjected to cruelty or harassment by her husband or any relative of her husband for, or in connection with, any demand for dowry, such death shall be called โdowry deathโ, and such husband or relative shall be deemed to have caused her death.
Explanation. For the purposes of this sub-section, โdowryโ shall have the same meaning as in section 2 of the Dowry Prohibition Act, 1961 (28 of 1961).
Explained in Simple Words
Section 80 of the Bharatiya Nyaya Sanhita (BNS) deals with dowry death. It applies when a woman dies because of burns or bodily injury, or occurs otherwise than under normal circumstances within seven years of her marriage, and it is shown that soon before her death she was subjected to cruelty or harassment by her husband or any relative of her husband for, or in connection with, any demand for dowry. Once these facts are shown, the death is called dowry death and the husband or relative is deemed to have caused her death.
This section matters because it is one of the strongest legal provisions used where a married woman dies in unnatural circumstances after dowry-related abuse. Under Section 80(2) BNS, committing dowry death is punishable with imprisonment for a term which shall not be less than seven years but which may extend to imprisonment for life. In practice, trials under this section focus on the timing of marriage, medical evidence of the cause of death, and proof of dowry-related cruelty or harassment soon before death.
Key Ingredients
- The death of a woman caused by burns or bodily injury or occurring otherwise than under normal circumstances within seven years of marriage
- Proof that soon before her death she was subjected to cruelty or harassment by her husband or any relative of her husband for, or in connection with, any demand for dowry
- The deemed causation of death by such husband or relative
Punishment
๐ Imprisonment for a term which shall not be less than seven years but which may extend to imprisonment for life.
๐ฐ The section prescribes no fine.
Committing dowry death carries imprisonment for not less than seven years, which may extend to imprisonment for life. It is cognizable and non-bailable, triable by the Court of Session.
Real-World Example
When This Does Not Apply
- The death of the woman occurred more than seven years after her marriage
- The death did not occur from burns or bodily injury and did not occur otherwise than under normal circumstances
- The woman was not subjected to cruelty or harassment by her husband or any relative of her husband soon before her death
- The cruelty or harassment was not for, or in connection with, any demand for dowry
Previous Law
IPC 304B โ Section 80(1) BNS
Section 304B IPC is now Section 80(1) BNS. The title, the definition of dowry death, the seven-year period, the deeming provision, and the punishment of imprisonment for not less than seven years extending up to imprisonment for life are unchanged.
Section 80(2) BNS: Dowry death
โถ
Bare Act Text
(2) Whoever commits dowry death shall be punished with imprisonment for a term which shall not be less than seven years but which may extend to imprisonment for life.
Explained in Simple Words
Section 80(2) of the Bharatiya Nyaya Sanhita (BNS) prescribes the punishment for the offence of dowry death defined in Section 80(1) BNS. It applies to a woman's husband or any relative of her husband who is deemed under Section 80(1) BNS to have caused her dowry death. Whoever commits dowry death shall be punished with imprisonment for a term which shall not be less than seven years, but which may extend to imprisonment for life.
Notably, Section 80(2) BNS fixes a mandatory minimum sentence of seven years of imprisonment and allows a maximum sentence of imprisonment for life, while the enacted text does not prescribe any fine for this offence.
This punishment applies only when all elements of dowry death under Section 80(1) BNS are established: the death of a woman was caused by burns or bodily injury or occurred otherwise than under normal circumstances within seven years of her marriage, and soon before her death she was subjected to cruelty or harassment by her husband or any relative of her husband for, or in connection with, any demand for dowry as defined in the Dowry Prohibition Act, 1961.
