131. Procedure in respect of person present in Court

If the person in respect of whom such order is made is present in Court, it shall be read over to him, or, if he so desires, the substance thereof shall be explained to him.

Section 131 BNSS in Simple Words

Section 131 of the Bharatiya Nagarik Suraksha Sanhita, 2023 deals with the procedure in respect of a person present in Court. If the person in respect of whom such order is made is present in Court, the order shall be read over to the person, or, if the person so desires, the substance of the order shall be explained to the person.

When Section 131 BNSS Applies

  • Section 131 BNSS applies if the person in respect of whom such order is made is present in Court.
  • The order shall be read over to the person.
  • If the person so desires, the substance of the order shall be explained to the person.

Example of Section 131 BNSS

An order is made in respect of Vivek, and Vivek is present in Court. Under Section 131 BNSS, the order shall be read over to Vivek, or, if Vivek so desires, the substance of the order shall be explained to Vivek.

When Section 131 BNSS Does Not Apply

  • Section 131 BNSS speaks of a person who is present in Court. It does not deal with a person who is not present in Court, which is the subject of Section 132 BNSS.
  • Section 131 BNSS speaks of reading over the order or explaining its substance. It does not deal with the copy of the order that accompanies a summons or warrant, which is the subject of Section 133 BNSS.
