Section 69 BSA in Simple Words
Section 69 of the Bharatiya Sakshya Adhiniyam, 2023 deals with an attested document (a document signed in the presence of a witness who also signs it) from 1 July 2024. When a party to an attested document admits executing (signing to make valid) that paper, the admission is sufficient proof of execution against that party.
The rule in Section 69 BSA applies even when the law requires the document to be attested. Once the party admits signing the document, no further evidence is needed to prove execution against that admitting party.
However, the admission proves execution only against the party who made the admission. Section 69 BSA makes the party admission sufficient proof of signing solely as against that signer.
When Section 69 BSA Applies
- Applies when a party to an attested document admits executing that document.
- Treats that admission as enough proof of execution against the party who made the admission.
- Applies even when the law requires the document to be attested.
