Example of Section 237 CrPC

Vikram is accused of an offence under Section 199(2) CrPC, and a Court of Session takes cognizance of the offence. Mahesh is the person against whom the offence is alleged to have been committed. The Court of Session shall try the case in accordance with the procedure for the trial of warrant-cases instituted otherwise than on a police report before a Court of Magistrate, and Mahesh shall, unless the Court of Session for reasons to be recorded otherwise directs, be examined as a witness for the prosecution. Because Vikram so desires, the trial is held in camera under Section 237(2) CrPC. The Court of Session acquits Vikram and is of opinion that there was no reasonable cause for making the accusation. Under Section 237(3) CrPC, the Court of Session directs Mahesh to show cause why Mahesh should not pay compensation to Vikram. The Court of Session records and considers the cause shown. Being satisfied that there was no reasonable cause for making the accusation, the Court of Session makes an order, for reasons to be recorded, that compensation to an amount not exceeding one thousand rupees be paid by Mahesh to Vikram.
