Section 155 IEA Bare Act Text

155. Impeaching credit of witness

The credit of a witness may be impeached in the following ways by the adverse party, or, with the consent of the Court, by the party who calls him:โ€”

(1) By the evidence of persons who testify that they, from their knowledge of the witness, believe him to be unworthy of credit;

(2) By proof that the witness has been bribed, or has accepted the offer of a bribe, or has received any other corrupt inducement to give his evidence;

(3) By proof of former statements inconsistent with any part of his evidence which is liable to be contradicted;

Explanation

A witness declaring another witness to be unworthy of credit may not, upon his examination-in-chief, give reasons for his belief, but he may be asked his reasons in cross-examination, and the answers which he gives cannot be contradicted, though, if they are false, he may afterwards be charged with giving false evidence.

Illustrations

(a) A sues B for the price of goods sold and delivered to B.

C says that he delivered the goods to B.

Evidence is offered to show that, on a previous occasion, he said that he had not delivered goods to B. The evidence is admissible.

(b) A is indicted for the murder of B.

C says that B, when dying, declared that A had given B the wound of which he died.

Evidence is offered to show that, on a previous occasion, C said that the wound was not given by A or in his presence.

The evidence is admissible.

Section 155 IEA in Simple Words

Section 155 of the Indian Evidence Act, 1872 sets out how a party can impeach (challenge) the credit (worthiness of belief) of a witness. The adverse party (the opposing side in the case) can do so directly. The party who called the witness can also do so if the court gives consent.

Under clause (1), a party can call other persons who know the witness. Those persons testify that they believe the witness cannot be trusted. Under clause (2), a party can prove a bribe, an accepted bribe offer, or another corrupt inducement (dishonest reward) for testifying.

Under clause (3), a party can prove earlier statements of the witness that conflict with parts of the testimony open to contradiction. The illustrations confirm that evidence of such earlier conflicting statements is admissible (allowed to be considered by the court).

Under the Explanation, a witness who declares another witness unworthy of credit cannot give reasons during examination-in-chief (initial questioning by the caller). The opposing side can ask for those reasons in cross-examination (questioning by the opposing side). Those answers cannot be contradicted, though false answers can lead to a charge of giving false evidence.

When Section 155 IEA Applies

  • The adverse party seeks to impeach the credit of a witness, or the calling party does so after getting court consent.
  • Under clause (1), other persons testify from personal knowledge of the witness that the witness cannot be believed.
  • Under clause (2), proof is offered that the witness took a bribe, accepted a bribe offer, or received a corrupt inducement.
  • Under clause (3), proof is offered of earlier statements that conflict with a part of the testimony open to contradiction.
  • In cross-examination, a witness who declared another witness unworthy of credit can be asked for the reasons behind that belief.

Example of Section 155 IEA

In 2023, Anita sues Ramesh in a court in Bhopal over a disputed land lease. Farhan testifies as a witness for Anita and states that the lease paper was signed at the office. Under clause (3) of Section 155 IEA, Ramesh offers proof that on an earlier occasion Farhan stated that no lease paper was ever signed at the office. That evidence is admissible under Section 155 IEA to impeach the credit of Farhan in the dispute over the land lease.

When Section 155 IEA Does Not Apply

  • Under clause (3), proof of earlier inconsistent statements applies only to a part of the testimony that is open to contradiction.
  • A witness who declares another witness unworthy of credit cannot state reasons for that belief during examination-in-chief.
  • Answers given in cross-examination about the reasons for believing a witness to be unworthy of credit cannot be contradicted.

Section 155 IEA in the BSA

Section 155 IEA is now covered under Section 158 BSA.

Section 155 of the Indian Evidence Act, 1872 became Section 158 of the Bharatiya Sakshya Adhiniyam, 2023 on 1 July 2024. No substantive change. The ways of impeaching credit are now lettered (a) to (c), and illustration (b) was reworded.
