Section 17 IEA in Simple Words

Section 17 of the Indian Evidence Act, 1872 defined what counted as an admission in a case. Under the Act, an admission was a statement that suggested an inference (a conclusion drawn from facts). That conclusion had to relate to a fact in issue (a main disputed fact) or a relevant fact.

The statement could be spoken, written in a document, or kept in electronic form. However, suggesting a conclusion about a fact was not enough on its own. The statement also had to be made by the persons and in the circumstances listed later in the Act.

When Section 17 IEA Applies

  • A statement was made orally, in a document, or in electronic form.
  • The statement pointed toward a conclusion about a disputed fact or a relevant fact.
  • The statement was made by a person, and in the circumstances, specified in the provisions that followed in the Act.

Example of Section 17 IEA

In 2022, Ramesh and Anita had a court dispute in Pune over whether a parcel of land was sold. Before the dispute, Ramesh had sent an electronic message that suggested a conclusion about that disputed sale. Under Section 17 IEA, that electronic message could qualify as an admission because it suggested an inference about a fact in issue. The message counted as an admission only if the sender and circumstances met the rules that followed in the Act.

Section 17 IEA in the BSA

Section 17 IEA is now covered under Section 15 BSA.

Section 17 of the Indian Evidence Act, 1872 became Section 15 of the Bharatiya Sakshya Adhiniyam, 2023 on 1 July 2024 without any change in wording.
