Section 59 IEA in Simple Words

Section 59 of the Indian Evidence Act, 1872 lets a party prove facts through oral evidence (spoken statements in court). Any fact can be proved this way, except what is inside a document or inside an electronic record.

The rule is permissive because the text states that facts may be proved through oral evidence. When a dispute involves a fact outside document contents or electronic record contents, spoken testimony from a witness can prove that fact.

Section 59 IEA carves out an exception for the contents of documents and for electronic record contents. A party cannot use oral evidence under Section 59 IEA to prove what a document or an electronic record contains.

When Section 59 IEA Applies

  • Applies when a party seeks to prove any fact in court through spoken testimony.
  • Applies only when the fact being proved is outside the contents of documents and outside electronic records.

Example of Section 59 IEA

In 2022, Ramesh brings a dispute in a Pune court and seeks to prove through spoken testimony that a car hit a gate and what is written inside a repair contract. Under Section 59 IEA, Ramesh may prove the fact that the car hit the gate through oral evidence. However, under Section 59 IEA, the contents of the repair contract document cannot be proved through oral evidence.

When Section 59 IEA Does Not Apply

  • Does not allow proving the contents of documents through oral evidence.
  • Does not allow proving the contents of electronic records through oral evidence.

Section 59 IEA in the BSA

Section 59 IEA is now covered under Section 54 BSA.

Section 59 of the Indian Evidence Act, 1872 became Section 54 of the Bharatiya Sakshya Adhiniyam, 2023 on 1 July 2024. The words "or electronic records" were dropped. "Document" in Section 2(1)(d) now "includes electronic and digital records".
