Example of Section 167 IPC

In 2016, in Ranchi, Suresh was a revenue inspector and a public servant who, as part of his official duties, was charged with preparing electronic land-holding records for farmers in his circle. While preparing the electronic record for a plot owned by Anwar, Suresh deliberately entered a reduced acreage that he knew to be incorrect, knowing that the false entry was likely to cause injury to Anwar by reducing his crop-compensation payout. Because he prepared an electronic record he knew to be incorrect while knowing it was likely to cause injury, Suresh is punishable under Section 167 IPC.

When Section 167 IPC Does Not Apply

  • The individual who prepared or translated the record was not a public servant.
  • Preparing or translating the document or electronic record was not part of the public servant's official duties.
  • The inaccuracy in the document or electronic record resulted from an accidental clerical error, and the public servant neither knew nor believed it to be incorrect.
  • The public servant had no intention to cause injury to any person and did not know that the incorrect entry was likely to cause injury.

Section 167 IPC in the BNS

Section 167 IPC is now covered under Section 201 BNS.

Section 167 IPC is now Section 201 BNS, with the same title, the same words and the same punishment.
