Section 221 IPC in Simple Words
Section 221 of the Indian Penal Code (IPC) punishes a public servant who is legally bound to apprehend or keep in confinement any person charged with or liable to be apprehended for an offence, and who intentionally omits to apprehend that person, intentionally suffers him to escape, or intentionally aids his escape or attempt to escape. The punishment is graduated based on the severity of the offence: imprisonment of either description for up to seven years, with or without fine, if the offence is capital; up to three years, with or without fine, if punishable with imprisonment for life or for ten years; and up to two years, with or without fine, if punishable with imprisonment for less than ten years.
The offence is bailable and triable by a Magistrate of the first class. Where the offence for which the person was to be apprehended is capital, the offence under Section 221 IPC is cognizable or non-cognizable according as that offence is cognizable or non-cognizable.
In the other two tiers it is cognizable.
