Example of Section 245 IPC

In 2016, Nitin, a maintenance contractor visiting a mint lawfully established in India at Noida to repair electrical wiring, picked up a collar ring and a stamping punch used as coining tools inside the workshop. Without lawful authority from the mint administration, Nitin hid the coining instruments inside his wooden toolbox and carried them out of the mint premises to his van parked on the street. Because he took coining instruments out of a lawfully established Indian mint without lawful authority, Nitin is punishable under Section 245 IPC.

When Section 245 IPC Does Not Apply

  • Section 245 IPC does not apply when the object removed from the mint is ordinary office equipment rather than a coining tool or instrument.
  • Section 245 IPC does not apply if the coining tool or instrument was taken from a private workshop rather than from a mint lawfully established in India.
  • Section 245 IPC does not apply where an official removes a coining instrument from the mint with lawful authority, such as under a valid order for official transfer or destruction.

Section 245 IPC in the BNS

Section 245 IPC is now covered under Section 188 BNS.

Section 188 BNS replaces Section 245 IPC with identical wording and statutory penalties. Both provisions penalize anyone who takes any coining tool or instrument out of a lawfully established mint in India without lawful authority. The maximum penalty remains imprisonment of either description for up to seven years along with fine.
