Section 376 IPC in Simple Words

Section 376 of the Indian Penal Code (IPC) prescribes penalties for the offence of rape. Under sub-section 1, a person committing rape is punished with rigorous imprisonment for not less than ten years extending to imprisonment for life, and is also liable to fine.

Sub-section 2 establishes enhanced sentences for aggravated rape, covering acts committed by police officers, public servants, armed forces personnel, custodial or hospital staff, persons in positions of trust or authority, during communal violence, upon pregnant or disabled women, inflicting grievous bodily harm, or repeated rape on the same woman. Aggravated rape carries rigorous imprisonment of not less than ten years extending to imprisonment for the remainder of natural life, and liability to fine.

Sub-section 3 punishes rape of a woman under sixteen years of age with rigorous imprisonment of not less than twenty years extending to natural life, and liability to fine. All categories under Section 376 IPC are cognizable, non-bailable, and triable by the Court of Session.

Ingredients of Section 376 IPC

  • Commission of the offence of rape as defined under Section 375 IPC
  • Under sub-section 1, commission of rape outside the aggravated categories specified in sub-section 2
  • Or under sub-section 2, commission of rape accompanied by statutory aggravating circumstances including custodial authority, position of trust, pregnancy, disability, or infliction of grievous bodily harm
  • Or under sub-section 3, commission of rape where the victim is a woman under sixteen years of age

Punishment Under Section 376 IPC

Imprisonment

Rigorous imprisonment of not less than ten years extending to imprisonment for life under sub-section 1; rigorous imprisonment of not less than ten years extending to imprisonment for the remainder of natural life under sub-section 2; and rigorous imprisonment of not less than twenty years extending to natural life under sub-section 3

Fine

Liable to fine under all three sub-sections; under sub-section 3 the fine must be just and reasonable to meet the medical expenses and rehabilitation of the victim, and is paid to the victim

Non-Bailable ⓘCognizable ⓘNon-Compoundable ⓘ🏛️ Court of Session ⓘ

Section 376 IPC prescribes graduated penalties for rape, ranging from ten years to imprisonment for the remainder of natural life with liability to fine. Aggravated forms under sub-section 2 carry ten years to imprisonment for the remainder of natural life, while rape of a woman under sixteen under sub-section 3 attracts an enhanced minimum sentence of twenty years. All offences under this section are cognizable, non-bailable, and triable by the Court of Session.

Example of Section 376 IPC

In 2021, in Guwahati, college lecturer Pradeep called his nineteen-year-old student Ritu to an empty lecture hall on the pretext of reviewing her examination script. Abusing his position of trust and authority as her teacher, Pradeep locked the door and committed rape upon Ritu against her will and without her consent. Under clause (f) of sub-section (2), rape committed by a teacher or a person in a position of trust or authority towards a woman attracts enhanced punishment. Pradeep is punishable under Section 376 IPC.

When Section 376 IPC Does Not Apply

  • Section 376 IPC does not apply when the ingredients of rape under Section 375 IPC are not established.
  • Section 376 IPC does not apply where sexual intercourse took place with the unequivocal voluntary consent of a woman aged eighteen years or older of sound mind.
  • Section 376 IPC does not apply to a medical procedure or intervention excluded from the definition of rape by Exception 1 to Section 375 IPC.
  • The enhanced penalty under sub-section (3) of Section 376 IPC does not apply when the woman was sixteen years of age or older at the time of the offence.

Section 376 IPC in the BNS

Section 376 IPC is now covered under Section 64 BNS.

Section 376 IPC corresponds primarily to Section 64 BNS. Sub-sections 1 and 2 of Section 376 IPC are reenacted as sub-sections 1 and 2 of Section 64 BNS with identical punishments and elements. The clauses in sub-section 2 are re-lettered from clauses a to m because former clause i of the IPC had been omitted in 2018. Former sub-section 3 of Section 376 IPC, punishing rape on a woman under sixteen years of age, is now codified separately as Section 65(1) BNS with the same punishment of rigorous imprisonment of not less than twenty years extending to natural life and liability to fine.
