Section 417 IPC in Simple Words

Section 417 of the Indian Penal Code (IPC) prescribes the general punishment for cheating where no aggravated form is established. Whoever cheats is punished with imprisonment of either description for a term which may extend to one year, or with fine, or with both.

Under the First Schedule to the Code of Criminal Procedure, 1973, the offence is non-cognizable, bailable, and triable by any Magistrate. The offence is compoundable without the permission of the court by the person cheated under Section 320(1) CrPC.

Ingredients of Section 417 IPC

  • The accused committed cheating as defined under Section 415 IPC
  • The accused deceived a person, either by fraudulent or dishonest inducement to deliver property or consent to the retention of property, or by intentional inducement to do or omit an act causing damage or harm in body, mind, reputation, or property
  • The dishonest or fraudulent intention existed at the time of the inducement or representation

Example of Section 417 IPC

In 2019 in Jaipur, Arvind intentionally deceived his neighbour Deepak by showing him a fabricated notice and falsely stating that the municipal authority had ordered the immediate demolition of Deepak's garden wall. Arvind knew from the outset that no such order existed. Believing the misrepresentation, Deepak demolished his own brick wall and suffered substantial damage to his property. Because Arvind deceived Deepak and intentionally induced him to perform an act he would not otherwise have done, causing damage to his property, Arvind committed cheating. Arvind is punishable under Section 417 IPC.

When Section 417 IPC Does Not Apply

  • A commercial agreement fails because of unexpected economic downturns when neither party had any fraudulent or dishonest intent at the beginning.
  • A party fails to fulfill a contractual obligation after entering into the arrangement sincerely and in good faith.
  • A person makes an honest promise intending to keep it at the time, even if circumstances later lead them to abandon it.
  • Harm or financial loss results from carelessness or an accidental mistake rather than intentional deception.

Section 417 IPC in the BNS

Section 417 IPC is now covered under Section 318(2) BNS.

Section 417 IPC corresponds to Section 318(2) BNS. While the definition of cheating is retained in Section 318(1) BNS without substantive change, the Bharatiya Nyaya Sanhita, 2023 increases the maximum imprisonment for simple cheating from one year under Section 417 IPC to three years under Section 318(2) BNS. Section 318(2) BNS also permits punishment with fine, or with both.
