- A penalty not listed in Section 53 IPC, such as whipping or banishment, is not a punishment to which an offender is liable under the Indian Penal Code.
- A sentence of transportation is outside Section 53 IPC because that category of punishment has been removed from the provision.
- Section 53 IPC does not by itself define the ingredients of any crime or fix the term of imprisonment or amount of fine for a specific offence.
Section 53 IPC in the BNS
Section 53 IPC is now covered under Section 4 BNS.
Section 4 BNS keeps the five punishments and adds a sixth. Community service is now listed as clause f. The BNS also letters the clauses a to f, in place of the IPC words First, Secondly, Fourthly, Fifthly and Sixthly, and says this Sanhita where the IPC said this Code. It is now the first section of Chapter II of the BNS.
