Section 25 BSA in Simple Words

Section 25 of the Bharatiya Sakshya Adhiniyam, 2023 explains the legal weight of an admission. Under the Adhiniyam, an admission is not conclusive proof (final proof of a fact) of the matter that was admitted. Merely admitting a fact does not settle that fact beyond all dispute.

At the same time, Section 25 BSA states that admissions may work as an estoppel (a rule that stops a person going back on an earlier statement). Whether an admission works in that way depends on the estoppel provisions contained later in the Adhiniyam.

When Section 25 BSA Applies

  • Applies when an admission of a fact is placed before a court, providing that the admission is not conclusive proof of what was admitted.
  • Applies where an admission may work as an estoppel under the later provisions of the Adhiniyam.

Example of Section 25 BSA

In October 2024, Farhan files a suit in Jaipur over the ownership of a warehouse claimed by Priya. Farhan relies on a prior note in which Priya admitted that the warehouse belonged to the family firm. Under Section 25 BSA, that admission is not conclusive proof of the ownership of the warehouse. Unless the estoppel rules later in the Adhiniyam apply, the admission does not finally decide who owns the warehouse.

Section 25 BSA in the IEA (Previous Law)

Section 25 BSA replaces Section 31 IEA from the old criminal code.

Section 31 of the Indian Evidence Act, 1872 became Section 25 of the Bharatiya Sakshya Adhiniyam, 2023 on 1 July 2024 without any change in wording.
