Section 31 IEA in Simple Words
Section 31 of the Indian Evidence Act, 1872 explained the legal weight of an admission. Under the Act, an admission was not conclusive proof (final proof of a fact) of the matter that was admitted. Merely admitting a fact did not settle that fact beyond all dispute.
At the same time, Section 31 IEA stated that admissions may work as an estoppel (a rule that stops a person going back on an earlier statement). Whether an admission worked in that way depended on the estoppel provisions contained later in the Act.
When Section 31 IEA Applies
- Applies when an admission of a fact is placed before a court, providing that the admission is not conclusive proof of what was admitted.
- Applies where an admission may work as an estoppel under the later provisions of the Act.
