Section 45 BSA in Simple Words

Section 45 of the Bharatiya Sakshya Adhiniyam, 2023 deals with the grounds (the reasons or basis) behind a relevant opinion. Whenever a living person gives a relevant opinion, the reasons supporting that opinion are also relevant.

This rule means a witness giving a relevant opinion does not have to state a bare conclusion alone. The witness can also place before the court the reasoning and observations that support the opinion.

The illustration to Section 45 BSA shows how the rule works for an expert. An expert giving a relevant opinion can describe the experiments carried out to reach that conclusion.

When Section 45 BSA Applies

  • The opinion of a living person is relevant in a court proceeding.
  • The reasons and basis on which that living person forms the opinion are also relevant.
  • An expert can describe the experiments carried out to form a relevant opinion.

Example of Section 45 BSA

In August 2024, during a trial in a Jaipur court, Farhan gives a relevant opinion about a disputed signature on a deed and explains the stroke patterns that support that conclusion. The opposing party objects to the explanation of the stroke patterns on the deed. Under Section 45 BSA, because the opinion of a living person is relevant, the grounds supporting that opinion are also relevant. Therefore, the Jaipur court treats the explanation of the stroke patterns on the disputed deed as relevant.

Section 45 BSA in the IEA (Previous Law)

Section 45 BSA replaces Section 51 IEA from the old criminal code.

Section 51 of the Indian Evidence Act, 1872 became Section 45 of the Bharatiya Sakshya Adhiniyam, 2023 on 1 July 2024 without any change in wording.
