Section 134 IEA in Simple Words

Section 134 of the Indian Evidence Act, 1872 states that proving a fact needs no fixed count of witnesses. Under the Act, a party can prove a fact in court without calling a set count of people to testify.

Section 134 IEA applies in every case. The Act does not demand a minimum count of witnesses before a court can accept a fact as proved.

The rule covers proving any fact in dispute. A party does not lose on a point merely for calling a single witness instead of several witnesses. Under Section 134 IEA, the law sets no required witness count for establishing a fact.

When Section 134 IEA Applies

  • Applies in every case before a court where a fact has to be proved.
  • Applies to the proof of any fact by a party.
  • Allows a fact to be proved without requiring any fixed count of witnesses.

Example of Section 134 IEA

In 2022, Ramesh files a case in a court in Pune to prove that Farhan signed a receipt. Anita saw the signing and testifies in court about that event, while Ramesh calls no other witness. Farhan argues that the signing of the receipt cannot be proved by a single witness alone. Under Section 134 IEA, the court can hold that the signing of the receipt is proved because no fixed count of witnesses is required to prove a fact.

Section 134 IEA in the BSA

Section 134 IEA is now covered under Section 139 BSA.

Section 134 of the Indian Evidence Act, 1872 became Section 139 of the Bharatiya Sakshya Adhiniyam, 2023 on 1 July 2024 without any change in wording.
