Section 53A IPC in Simple Words

Section 53A of the Indian Penal Code (IPC) says how old references to transportation in other laws are to be read. A reference to transportation for life reads as imprisonment for life.

A reference to transportation for a term, or for a shorter term, is treated as omitted. A sentence of transportation for a term passed before the Code of Criminal Procedure Amendment Act of 1955 came into force is dealt with as rigorous imprisonment for the same term.

The section creates no offence and the Bharatiya Nyaya Sanhita has no equivalent.

Example of Section 53A IPC

In 2016, in Ranchi, prison superintendent Gopal and clerk Nandini examined a state statute in force and an order made under a repealed enactment. Those texts referred to transportation for life, to transportation for a term or shorter term, and to transportation generally. They also reviewed a file from 1954 in which prisoner Bhaskar had been sentenced to transportation for seven years before the 1955 amendment Act commenced. The life references were construed as imprisonment for life, the term and shorter term references were deemed omitted, and Bhaskar's sentence operated as rigorous imprisonment for seven years under Section 53A IPC.

When Section 53A IPC Does Not Apply

  • A statute or order that already speaks of imprisonment for life or rigorous imprisonment without mentioning transportation does not require construction under Section 53A IPC.
  • Sub-section (2) of Section 53A IPC does not apply to any sentence passed on or after the commencement of the Code of Criminal Procedure (Amendment) Act, 1955.
  • Section 53A IPC cannot be used to prosecute or punish a person because it is only a rule for construing references to transportation and creates no offence.
